  • Type of data collected:

  • Personal data (name, surname, details of an identification document and a copy of it, telephone, e-mail address, Iban, etc.), will be provided at the time of establishing the contractual relationship and the information collected is aimed at the correct execution of the activity.


  • Purpose and legal basis of processing

  • The personal data provided will be used as follows and regarding:

    • >  The execution of contractual obligations:

      • Processing related to the management of the contractual relationship established with you and pre-contractual activities;
      • Processing aimed at exercising the rights of the Controller, for example the recovery of unpaid debts;

    • Legal obligations:

      • Processing related to tax and accounting obligations;
      • Processing related to any other fulfilment required by current legislation.


  • Consequence of the failure to provide data

  • Pursuant to Article 13, paragraph 2, letter e), GDPR, we inform you that, considering the purposes of the processing as described above, the provision of data for the aforementioned purposes is mandatory and failure to provide it may, as a consequence, prevent the development of the contractual relationship. Likewise, the incorrect provision of data will make it impossible to carry out the activity as foreseen in the contract and will preclude compliance with the requirements established by law.


  • Processing method and data retention period

  • The processing will be performed both with manual and/or computer tools and with telematic tools with organizational and processing logic strictly related to the purposes themselves and in any case always in order to guarantee the security, integrity and confidentiality of the data in compliance with the organizational, physical and logical measures required by current regulations. The Data Controller will process personal data for the time necessary to fulfil the aforementioned purposes and in any case for the time defined by the law regarding the conservation of documents and related data of a civil, accounting and tax nature or for other purposes provided by law and regulation.


  • Categories of recipients to whom personal data can be communicated

  • Please note that your data may be made accessible for the purposes mentioned above:

    • To employees and collaborators of the Data Controller, in their capacity as processors and/or system administrators;
    • To third-party companies or other entities that carry out outsourced activities on behalf of the Data Controller for functional purposes as indicated above, in their capacity as data processors (e.g.: accountants, credit institutes, professional firms, consultants, insurance companies for the provision of insurance services, public bodies etc.);
    • To judicial or administrative authorities for the fulfilment of legal obligations. A list of external processors is available upon request at the registered office of Smipa S.r.l.

  • International data transfer or automated processing

  • Your personal data is neither subject to dissemination in a third country nor to any fully automated decision-making process, including profiling.


  • Rights of the data subject

  • You may exercise the right at any time to:

    • Access your personal data and information relative to it;
    • Obtain the correction of inaccurate data or the addition of incomplete data;
    • Obtain the deletion of personal data concerning you when the conditions provided for by Article 17 are verified (if the personal data is no longer necessary for the purposes it was collected and processed; if the data subject revokes consent r opposes processing, if the data is processed unlawfully, if personal data must be deleted to fulfil a legal obligation; if personal data was collected in relation to the provision of services of the company of information to minors);
    • Restrict the processing of data concerning you, assuming the hypothesis pursuant to Article 18 18 GDPR (if the data subject disputes the accuracy of personal data for the period necessary for the data controller to verify the accuracy of such personal data, if the processing is illegal, if the data is necessary for the verification and defence of a right in court, if the data subject has opposed processing in the case of a legal basis coinciding with the legitimate interest of the controller);
    • Oppose processing;
    • Obtain the portability of the data provided, if the data processed with automated means finds the legal basis in the contract or in the consent, in a structured and legible form by an automatic device, also to communicate this data to another Data Controller;
    • Revoke consent, where provided: revocation of the consent does not affect the lawfulness of the processing based on the consent conferred before the revocation;
